BaseballVMI Terms of Use Agreement

Welcome to BaseballVMI.com, a production of Air Resistance Technologies, Inc.

These terms of service are associated with the governing of this site and must be agreed to before you can access and become a member. Please read them carefully.

You represent that you are 18 years or over to register as a member and that you have the right, authority and capacity to abide by all terms and conditions of this agreement. BaseballVMI has the right at it's discretion to add, delete or modify the terms of this agreement without notice. It is the sole responsibility of the member to check this agreement periodically to review any changes made to this agreement.

1.  Payment/Fees and Termination of Membership.

Membership along with the content and services of this site are made available through the payment of a fee determined by BaseballVMI and your choice of the term of membership to which you subscribe.  All components of the membership package can be modified by BaseballVMI at its discretion without notice.  As a member you are responsible for all charges from the use of membership including any charges resulting from its usage. Members agree to forfeit fees paid if their membership is terminated for violating this agreement.

If a member uses a credit or debit card for subscription and the issuer seeks to recover from BaseballVMI any amounts paid for membership the members will pay all amounts necessary to comply with issuer's request including any costs and/or expenses incurred by BaseballVMI. 

2.  Terms of Membership. (Rules and Regulations)

1. BaseballVMI subscription membership is made available to anyone over the age of 18 who registers and pays the appropriate fee for the term of membership they choose. Members use a unique login name (their e-mail address) and password of their choosing. BaseballVMI does not discriminate on the basis of age, gender, sexual orientation, religion, nationality, ethnic background or race.
2. One membership is allowed per individual with a legitimate email address. This membership is non-transferable.
3. The information presented on this site is copyrighted information and is meant for personal use only. Any sharing, replication, or reposting of this information in any form, electronic or non-electronic is a violation of Copyright law. Such violation would result in immediate termination of member's account.
4. Members are responsible for extending their subscription manually. BaseballVMI does not provide recurring billing. Member account information and roster configurations will be maintained between lapses in subscription for up to one year. This includes the off-season period.
5. In season membership entitles the member to the current days VMIs for their unique roster and the current days VMIs of each Major Leage Team.

3.  Refunds.

Month by month subscriptions are not subject to refunds under any circumstances. Season passes and post season game memberships would qualify for pro-rated refunds if either the baseball season was interrupted or BaseballVMI was unable to provide up-to-date content as normally provided.

4.  Product Delivery and Shipping.

Product delivery is provided via normal web browsing in the browser of the member's choice. At this time BaseballVMI will not be delivering any physical product.

5.  Privacy Policy.

All information supplied by you is kept confidential by BaseballVMI including financial transactions, personal identity and email addresses.  This information will not be shared with third parties and will not be disclosed except if you engage in illegal activity or if requested via subpoena by law enforcement.

BaseballVMI does not store any personal information such as address and billing information on the website. Website information stored is limited to Name, E-Mail and password information for account validataion.

6.  Limitations of Liability and Warranty.

The member agrees that the use of the site is entirely at the member's own risk. This site is provided on an "as is" basis, without warranties of any kind. All express, implied, and statutory warranties, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights, are expressly disclaimed to the to the fullest extent permitted by law, and further disclaims any warranties for the security, reliability, timeliness, and performance of the site. As permitted by law, BaseballVMI disclaims any warranties for other services or goods received through or advertised on the site or through any links provided on the site, as well as for any information or advice received through the site or through any links provided in the site.  Neither BaseballVMI nor any third-party content provider makes any warranty with respect to any content, information, services, or products provided through or in conjunction with the site. 

BaseballVMI may amend this agreement at any time with or without notice.
